Terms of Sale

1. Professional customers

Paid offers are reserved for professionals: individuals or legal entities acting for purposes related to their trade, business, craft or profession, including freelancers and founders. By ordering, you confirm that you act in that capacity. Protections reserved to consumers, such as the right of withdrawal, therefore do not apply, except where mandatory law provides otherwise.

2. Plans and features

The features, limits (such as the number of competitors you can track) and price of each plan are described on the website or on the order page at the time of your order. The Service evolves: we may improve or modify features, provided that the essential features of your plan are maintained during the period you have paid for.

3. Ordering

You order online by choosing a plan and a billing period, providing your billing details and accepting these Terms of Sale. The contract is formed when your payment is confirmed. We send you a confirmation by email.

4. Prices

Prices are shown excluding taxes, in euros or in the currency displayed at checkout. Applicable taxes, such as VAT, are added according to the rules in force and your billing details.

We may change our prices. A new price applies from your next billing period and is notified to you at least 30 days in advance; if you do not accept it, you can cancel before the renewal date.

5. Payment and invoices

Payment is made in advance, by card or any other method offered at checkout, through a third-party payment provider. We do not store your full card details. Invoices are issued electronically.

If a payment fails, we may suspend paid features after a reminder. Late payments bear the late-payment interest provided by law and the fixed recovery indemnity of 40 euros due between professionals (article L441-10 of the French Commercial Code).

6. Duration, renewal and cancellation

Subscriptions are monthly or yearly and renew automatically for the same duration unless cancelled. You can cancel at any time from your account or by writing to contact@weespy.app. Cancellation takes effect at the end of the current billing period, and you keep access until then.

Amounts already paid are not refunded, including for unused periods, except where these Terms of Sale or the law provide otherwise.

7. Changes, suspension and termination by the Seller

If we substantially reduce the essential features of your plan, you may terminate your subscription and receive a refund of the unused part of the period you paid for.

We may terminate your subscription in case of serious breach of the Terms of Service or of these Terms of Sale, after a notice that remains without effect for 15 days, or immediately in case of fraud or unlawful use. If we discontinue a paid offer, we give at least 30 days’ notice and refund the unused part of the period you paid for.

8. Our commitment

Paid features are provided with a best-efforts obligation. We do not guarantee any particular result, such as traffic, revenue or rankings, from the use of the insights provided.

9. Liability

To the extent permitted by law, the Seller’s total liability under a subscription is limited to the amounts you paid for it during the 12 months preceding the event giving rise to the claim. Indirect damages, such as loss of profit, business or data, are excluded. These limits do not apply in case of gross negligence or wilful misconduct, or where liability cannot be limited by law.

10. Personal data

The personal data processed for orders and billing are described in our Privacy Policy. Billing records are kept for the period required by accounting law.

11. Changes to these Terms of Sale

The version that applies to an order is the one you accepted when ordering. For renewals, a new version applies from the next billing period, provided it was notified to you at least 30 days in advance.

12. Governing law and disputes

These Terms of Sale are governed by French law. Before any legal action, please contact us at contact@weespy.app so that we can look for an amicable solution. Failing that, any dispute between professionals falls under the exclusive jurisdiction of the competent courts of the place of the Seller’s registered office.

These terms are available in French and English. In case of discrepancy, the French version prevails.
